4 AI-Generated Content and Automation

5 Client Approval

7 Customer Responsibilities

The customer agrees to provide accurate and timely information required for GrowOnline to provide its services.

Customers are responsible for ensuring that:

  • They have permission to provide images, logos, videos, trademarks and other materials supplied to GrowOnline.
  • They have the necessary rights to use material they provide.
  • They provide timely feedback and approvals.
  • They comply with applicable laws and platform rules.
  • They do not request GrowOnline to create or distribute unlawful or harmful content.

8 Intellectual Property

Client-Owned Materials

Materials supplied by the client remain the client's property unless otherwise agreed in writing.

GrowOnline Materials

GrowOnline's pre-existing systems, templates, processes, workflows, strategies, software, branding, proprietary methods and technology remain the property of GrowOnline unless expressly transferred in writing.

Third-Party Materials

Third-party software, AI models, stock assets, music, fonts, images, platforms and other licensed materials remain subject to their respective licences and terms.

Custom Deliverables

Ownership or usage rights for custom deliverables will depend on the specific service agreement, quotation or package purchased. GrowOnline does not automatically transfer all intellectual property rights unless specifically agreed in writing.

9 AI and Third-Party Platforms

GrowOnline may rely on third-party services such as AI platforms, cloud services, hosting providers, advertising platforms, social media platforms, payment providers, analytics tools, automation platforms and communication tools.

Third-party services may have their own terms, policies, limitations, pricing and availability. GrowOnline cannot guarantee the uninterrupted availability of third-party platforms.

10 Payments and Fees

11 Advertising Spend

Where GrowOnline manages advertising campaigns, advertising budgets paid to platforms such as Meta, Google or other advertising networks may be separate from GrowOnline's management fees.

GrowOnline does not control advertising-platform charges, algorithm changes, account restrictions or campaign approval decisions.

12 Cancellation and Termination

Either GrowOnline or the customer may terminate services in accordance with the applicable service agreement, quotation or package terms.

The following matters will be addressed on termination:

  • Cancellation of services
  • Recurring services
  • Outstanding payments
  • Work already completed
  • Work in progress
  • Third-party costs already incurred

GrowOnline may suspend services for non-payment or terminate services for breach of these Terms, in accordance with the applicable agreement and applicable law.

13 Refunds

Refund eligibility depends on the service purchased, the applicable agreement and applicable law.

Services that have already been performed, customised or delivered may not necessarily qualify for a refund. Nothing in these Terms limits or excludes any refund rights the customer may have under applicable South African consumer-protection law.

14 Prohibited Uses

Customers may not use GrowOnline's services to:

  • Break the law
  • Commit fraud
  • Mislead or deceive people
  • Distribute malware
  • Infringe copyright or trademarks
  • Harass or threaten people
  • Create unlawful content
  • Violate advertising-platform policies
  • Violate third-party platform terms
  • Impersonate another person or business
  • Conduct activities that could reasonably harm GrowOnline or others

GrowOnline may refuse or terminate services where a request creates legal, ethical or significant reputational risk.

15 Website Use
